Explore Your AAT Appeal Option upon Visa Rejection
An Administrative Appeals Tribunal (AAT) is an independent tribunal in Australia that evaluates decisions taken by government agencies, including a visa refusal by the Department of Home Affairs. In case your visa has been rejected or refused, you may file an appeal with the AAT within the stipulated time period of 21 days from the date of visa refusal. This time frame may vary as per your visa type and specific circumstances.
After the appeal is submitted with AAT, you get a confirmation letter and AAT will notify you regarding the further steps you may need to take. You may be required to provide additional information and documentation to support your appeal against the rejection of the visa. The AAT will review the case and take an independent decision based on its evaluation of the presented documents and on the merits of the evidence presented.
AAT has the final authority to make decisions regarding your visa refusal appeal and it cannot be overridden by the Department of Home Affairs. AAT has the authority to review decisions made by Department of Home Affairs and other government departments on the following matters
- Visa Refusals
- Visa Cancellations
- Citizenship Refusals
- Security Assessment
- Freedom of Information (FOI) requests
- Taxation (decisions made by the Australian Taxation Officer)

Your Seamless Appeal Submission Journey
AAT Procedure - The Beginning
The process of submitting AAT Appeals starts with lodging a review application with AAT within 21-28 days from the date of refusal. You can refer to the timeframe specified in the decision copy. After the AAT receives your application, you will get a receipt of acknowledgement that your appeal application has been lodged. You may be required to submit additional information or documentation either at the time of lodging of appeal or later in the process.
Case Management Undertaking by AAT
After appeal is lodged, AAT will take up case management activities that are mainly aimed at preparing your case for review. It includes identifying the issues in dispute, arranging necessary translations or interpreters, and setting a date for hearing when this matter will be taken up. Case management is followed by review in which AAT thoroughly reviews the case including documentation and information that has been provided by the appellant. Additional documents or information may be requested from you or any third parties involved.
Hearing Before AAT
If the AAT determines that a hearing is necessary, a date and time will be scheduled for the same. We provide you with the representation you need before the tribunal to present your case in a better light. All the involved parties are given adequate time and opportunity to present evidence and arguments in favour of or against your appeal. Hearings may be held in person, via video conference or through phone
Decision and Further Action
Based on the evidence and arguments conducted before and during the hearing, AAT will take its decision. Written reasons will be provided for their decision and any orders made will be started. After the decision is made, further action is warranted. If the appeal is successful, AAT remits the case to the original decision-making body with instructions on how to proceed. If your appeal is unsuccessful, you still have the option to go for a judicial review.
